Mississippi on Tuesday filed a lawsuit in Lafayette County Circuit Court against Indianapolis-based Eli Lilly over allegations that the pharmaceutical company improperly marketed the antipsychotic drug Zyprexa for "off-label" uses, "defraud[ing] the state out of millions of dollars in Medicaid reimbursements," the Jackson Clarion Ledger reports.
The suit alleges that representatives for Eli Lilly convinced Mississippi doctors to prescribe the drug to patients who suffered from anxiety, mood swings and disturbed sleep while the drug was approved only for treatment of bipolar disorder and schizophrenia.
The suit also alleges that the pharmaceutical company did not properly emphasize the dangers of the drug, such as an increased risk of diabetes. Those Medicaid beneficiaries who became ill from the drug consequently increased the state's Medicaid expenditures, the suit states.
The suit alleges damages of $30 million in prescription costs alone, and the state also will seek civil penalties, punitive damages and litigation costs, Tim Balducci, Mississippi special assistant attorney general, said. Zyprexa, which is among the top drugs paid for by Medicaid, was improperly marketed "in an attempt to expand the market share of the drug," Balducci said.
He added that Eli Lilly targeted the state of Mississippi because its Medicaid system does not stringently oversee the prescription of drugs for off-label uses. Eli Lilly has 30 days to respond to the suit. A spokesperson for the company did not comment on the suit (Joyner, Jackson Clarion Ledger, 7/25).

June 30, 2006 is a day that will be long remembered as a dark milestone in the history of FDA and its campaign against health consumers. On June 30, an FDA “Final Rule” goes into effect, establishing a regulatory power grab of such scale and scope that it attempts to bypass all laws, the will of Congress and fundamental protections for consumers.
This “Final Rule,” which may as well be called a “Final Solution” for drug consumers, claims that consumers can no longer sue drug companies for the harm caused by any FDA-approved drug, even if the drug’s manufacturer intentionally misled the FDA by hiding or fabricating clinical trial data.
In one blatantly illegal act, the FDA is attempting to pull off the greatest Big Pharma coup of all: The outright elimination of any responsibility whatsoever for the suffering and death caused by deadly pharmaceuticals.
In the preamble of the FDA’s new “Final Rule” to take effect on June 30, the agency asserts that FDA approval of prescription drugs — and their implied safety — may no longer be second-guessed by consumers or organizations of any kind. The FDA’s stamp of approval, the agency claims, is an absolute declaration of safety of all such drugs, for any use whatsoever, including off-label use (the use of drugs on health conditions that were never tested in clinical trials).

How does Zyprexa cause diabetes? It has been theorized that Zyprexa causes diabetes by poisoning the pancreatic beta cells causing them to die off. On July 1, 2002, Duke University issued a Press Release about the most recent finding that links the new anti-psychotics to early onset diabetes. The team of researchers--Elizabeth A. Koller, M.D. from the FDA, and Murali Doraiswamy, M.D. from Duke-- analyzed FDA's adverse drug report database, MedWatch (which receives 10% of adverse drug reports). They identified 289 cases of diabetes in patients who had been prescribed olanzapine (a.k.a. Zyprexa), Eli Lilly's most profitable drug.
The researchers reported: "Of the 289 cases of diabetes linked to the use of olanzapine, 225 were newly diagnosed cases. One hundred patients developed ketosis (a serious complication of diabetes), and 22 people developed pancreatitis, or inflammation of the pancreas, which is a life-threatening condition. There were 23 deaths, including that of a 15-year-old adolescent who died of necrotizing pancreatitis, a condition where the pancreas breaks down and dies. Most cases (71 percent) occurred within six months of starting the drug and many cases were associated with moderate weight gain."

The results of the huge government-sponsored study CATIE, or Clinical Antipsychotic Trials in Intervention Effectiveness, were released last September. Eli Lilly's Zyprexa was the most effective drug in the trial, but its victory was dulled by the medicine's side effects.
